An Overview of Overtime Law in TN


The Fair Labor Standards Act of 1938 is a federal law that requires employers to pay one and one-half times an employee’s regular rate of pay (“time and a half”) for all hours that an employee works above forty in a workweek. It applies to most employees, and is one of the most violated laws in the American workplace.

While there are a few categories of employees who may be paid a flat salary, too many employers think they can avoid paying overtime by making an employee “salaried.” This is not true. Many salaried employees are entitled to overtime pay.

Other employers try to avoid paying overtime by working employees “off the clock.” Many employees are worked through their lunch breaks, or they are refused pay for travel time. Some employers also make employees do things to prepare for work, such as filling out paperwork or putting on safety gear, without paying them.
